Free Local Shipping Offer Policy:
For a limited time we will be offering free delivery to our local community. At checkout if your delivery address is within postcodes (3337,3338,3340,3437,3335) then you will receive a free shipping option. These deliveries will be done by our own drivers, during our normal scheduled gas delivery routes, and at our convenience. Tracking is not available. Eureka Gas and Gear reserves the right to alter or cease Free Local Shipping at any time, and potentially cancel orders where an honest mistake was made on our end.
Privacy:
Eureka Gas and Gear is committed to protecting your Privacy in accordance with National Privacy Law. We will not disclose your data to anyone unless required to do so by law.
When making a transaction through our on-line store your information will pass through a secure server using SSL (secure sockets layer) encryption technology. The encryption process ensures that your information cannot be read by or altered by outside influences.
Our on-line store uses a technology called cookies (a small element of data that our website may send to your computer) that may be used to provide you with specific information for the purpose of us tracking site usage and traffic. These cookies do not read your hard drive but may be stored on your hard drive to enable our website to recognise you when you return to the store.

Goods displayed for sale on our website does not guarantee the availability of any particular Good(s), therefore all orders placed through our website shall be subject to confirmation of acceptance by us. Orders for Services shall be subject to confirmation of suitable timeframes between you and ourselves for provision of the Services.
Products on our website may appear different to the end product received. Parts are updated and refreshed often, and images may not reflect the exact look of the product.

Due to the inherent technical nature of websites we cannot guarantee uninterrupted or continuous availability of our website and it may be unavailable from time to time for maintenance or scheduled upgrades. It may also be unavailable due to technical problems at our provider or the NBN network. Where we able to, we’ll give you advanced warning of any downtime. We accept no liability in relation to website downtime whether scheduled or otherwise.
Termination of Use:
These terms and your access to our website may be terminated by us (at our sole discretion) at any time without notice or any requirement to give you a reason why. In the event of termination under this clause we shall have no liability to you whatsoever (including for any consequential or direct loss you may suffer).
Returns / Exchanges:
Eureka Gas and Gear do not accept returns for change of mind.
We understand that sometimes you may need to return a product you have purchased from us. To assist you, here is our returns policy:
Our Returns Policy includes the rights you have under Australian Consumer Law and other relevant laws.
Your Rights under Australian Consumer Law
Our goods come with guarantees that under Australian Consumer Law cannot be excluded.
You are entitled to a replacement product or refund in the event of a major failure of a product and for compensation for any other reasonably foreseeable loss or damage.
You are entitled to have goods repaired or replaced if the goods are demonstrably of unacceptable quality and the failure does not amount to a major failure.
The buyer shall inspect the Goods on delivery and within seven (7) days of delivery (time being of the essence) shall notify Eureka Gas and Gear of any alleged defect, shortage in quantity, damage or failure to comply with the description or quote.
The buyer shall also afford Eureka Gas and Gear the opportunity to inspect the Goods within a reasonable time following delivery if the buyer believes the Goods are defective in any way.
If the buyer fails to comply with these provisions the Goods shall be presumed to be free from any defect or damage.
For defective Goods, which Eureka Gas and Gear has agreed in writing that you are entitled to reject, Eureka Gas and Gear’s liability is limited to either (at Eureka Gas and Gears discretion) replacing the Goods or repairing the Goods.
Returns will only be accepted provided that:
(a) You have complied with the provisions outlined above, and
(b) where the Goods are unable to be repaired, the Goods are returned at your cost within thirty (30) days of the delivery date, and
(c) The Goods have been stored and used in a proper manner, in compliance with manufacturers instructions.
(d) The Goods are returned in the condition in which they were delivered and with all packaging material, brochures and instructional material in an ‘as new’ condition as is reasonably possible in the circumstances.
Special orders, i.e. goods which we have acquired specifically to your order specifications are not returnable except where they fail to comply with Australian consumer law.
